Medicare Marketing Compliance: The Guide for Agents

Medicare is one of the most heavily regulated industries you can market in. One non-compliant ad can get your ad account banned, trigger a carrier audit, or worse — cost you your appointments with carriers. The good news: staying compliant isn't complicated if you follow a few core principles.

The Golden Rule of Medicare Marketing Compliance

Educate first, sell second. Nearly every CMS marketing guideline is built around preventing high-pressure, misleading, or plan-specific solicitation before a prospect understands their options. When your marketing promotes a free educational workshop or webinar — not a specific plan or premium — you're structurally compliant by design. That's exactly how the T65 lead generation model is built.

What CMS Rules Actually Prohibit

  • Misleading claims: implying a plan is "free" without qualification, or that it's the "best" or "only" option.
  • Unsolicited contact: cold-calling or door-knocking prospects who haven't asked for information.
  • Plan-specific ads without disclaimers: ads that market a specific plan must include required disclaimers and carrier approval.
  • Impersonating Medicare: using CMS or Medicare logos, or implying you represent the government.
  • Pressure tactics: creating false urgency around enrollment deadlines that don't apply to the prospect.

Compliant Ad Copy for Medicare Agents

Compliant ad copy promotes education, not plans. Compare:

Non-compliant: "FREE Medicare Advantage plan — $0 premium! Call now before open enrollment ends!"

Compliant: "Turning 65? Attend a free local workshop and learn about your Medicare options — Parts A, B, C, and D explained in plain English. Reserve your seat."

The second ad sells nothing, promises nothing, and educates — which is both compliant and, notably, higher-converting with the 60+ audience. For more detail, see our full Facebook Ads for Medicare Agents compliance guide.

Compliance for Webinars and Seminars

Educational events must be genuinely educational. Present the full landscape of options (Original Medicare, Advantage, Supplements, Part D), disclose that the event is for educational purposes only and that no plan-specific benefits will be discussed unless a licensed agent presents them, and never require attendance to receive a "gift" of meaningful value. Collect RSVPs through a registration funnel — never a sales page.

Compliance for Follow-Up (Email & SMS)

Every follow-up message must be TCPA-compliant: capture express written consent on your registration form, include opt-out language in every SMS, and honor opt-outs immediately. Automated reminders about an event the prospect registered for are transactional and safe; unprompted sales pitches are not.

Why Most Agents Outsource Compliance

Compliance isn't a one-time checklist — carriers update guidelines annually, and every new ad, email, and landing page needs review. That's why most agents hand marketing to a done-for-you partner whose entire job is running compliant campaigns. The T65 Client Acquisition System handles all of it — ad copy review, funnel compliance, and follow-up automation — as part of the monthly service.
